At the same time, Lamu has complex land-tenure questions involving community land, ancestral occupation, registered titles, customary interests, public land and compulsory acquisition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed Dangote East Africa Refinery has brought many of these issues into sharp public focus. The refinery was officially inaugurated in Lamu on <strong>30 September 2026<\/strong> and is planned as a 700,000-barrel-per-day facility. Recent reporting has also highlighted ongoing disputes concerning land ownership, compensation and the rights of people occupying land associated with the project.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On 28 September 2026, the Malindi Environment and Land Court directed parties to maintain the status quo concerning <strong>LR No. 13061 in the Hindi\/Manda Magogoni area<\/strong> pending an inter partes hearing scheduled for 14 October 2026. The applicants include residents who say they have occupied and used the land for generations and whose claims involve customary or community tenure, possession and beneficial use. These are claims made in ongoing litigation and should not be treated as findings by the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wider legal question is therefore important:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>How does Kenyan land law protect landowners, communities, occupiers and investors when major infrastructure and development projects take place in Lamu?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This guide explains the principal legal issues.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">1. Why Lamu Land Law Requires More Than a Title Search<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A conventional property transaction often starts with a simple question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Who is the registered proprietor?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That remains an essential question. However, in Lamu, it may not be the only question that matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A proper legal assessment may also need to consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>whether the land is private, public or community land;<\/li>\n\n\n\n<li>whether there are customary interests;<\/li>\n\n\n\n<li>whether the land has historically been occupied by a community;<\/li>\n\n\n\n<li>whether succession issues affect ownership;<\/li>\n\n\n\n<li>whether there are existing leases, charges, cautions or restrictions;<\/li>\n\n\n\n<li>whether the land falls within an infrastructure or planning corridor;<\/li>\n\n\n\n<li>whether compulsory acquisition is proposed or has occurred;<\/li>\n\n\n\n<li>whether compensation is outstanding;<\/li>\n\n\n\n<li>whether development permissions are required;<\/li>\n\n\n\n<li>whether environmental approvals apply;<\/li>\n\n\n\n<li>whether community or public participation requirements arise; and<\/li>\n\n\n\n<li>whether the proposed transaction is consistent with the applicable land-use plan.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution classifies Kenyan land as <strong>public, community or private land<\/strong> and requires land to be held and managed according to principles including equitable access, security of land rights, sustainable management, transparent administration and protection of ecologically sensitive areas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That constitutional framework is particularly important when examining land in a county undergoing rapid infrastructure and industrial development.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">2. What Types of Land Exist in Lamu?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Kenyan law recognises three broad categories:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Public land<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Public land includes categories specified under Article 62 of the Constitution.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Community land<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Article 63 recognises community land, including land lawfully registered in the name of a community, land held by communities identified on the basis of ethnicity, culture or similar community interest, and certain categories of ancestral, traditionally occupied or used land.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3. Private land<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Private land includes registered private land, land held under freehold tenure and certain leasehold interests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction matters because <strong>the procedure for dealing with each category of land is not necessarily the same<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person considering purchasing or developing land in Lamu should therefore establish the legal status of the property before entering into a binding transaction.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">3. Community Land in Lamu<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Community land is one of the most important areas of Lamu land law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Community Land Act, 2016<\/strong> provides the statutory framework for recognition, registration, administration and management of community land.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is particularly relevant because Lamu has been undertaking community-land registration initiatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In February 2026, the Lamu County Government announced the issuance of Certificates of Registration of Community Land to the <strong>Achuwei, Mvundeni, Simambae, Rubu and Mwambore communities<\/strong>. The county described the registration as a step toward securing community land ownership and improving tenure security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The county also announced a project to convert and register approximately <strong>10,000 acres at Chalaluma-Dide Waride<\/strong> as community land for the Orma community.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These developments demonstrate why investors and property buyers should not assume that every apparently available parcel in Lamu is ordinary private land.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Before buying land in or around a community-land area, a purchaser should establish:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the legal classification of the land;<\/li>\n\n\n\n<li>whether the community is registered;<\/li>\n\n\n\n<li>who has authority to deal with the land;<\/li>\n\n\n\n<li>whether the proposed transaction is legally permitted;<\/li>\n\n\n\n<li>whether there are existing community interests;<\/li>\n\n\n\n<li>whether the parcel has undergone adjudication or registration;<\/li>\n\n\n\n<li>whether there are competing claims; and<\/li>\n\n\n\n<li>whether the proposed use complies with planning and environmental requirements.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">4. What About Ancestral Land Without a Title Deed?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most important questions arising from Lamu&#8217;s land environment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person may say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cMy family has occupied this land for generations, but we do not have an individual title deed.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That does not automatically answer every legal question concerning the land.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kenyan land law recognises <strong>customary land rights<\/strong> where consistent with the Constitution. The Land Act identifies customary land rights as a form of land tenure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution also specifically recognises categories of community land involving ancestral land and land traditionally occupied or used by communities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the existence, nature and enforceability of a particular claim depend on the facts and applicable legal process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>No title deed does not necessarily mean no legally relevant interest exists.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, an allegation of ancestral occupation does not automatically establish ownership of a particular parcel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Evidence, land classification, registration records, adjudication records, historical occupation, community status and the applicable statutory framework all matter.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">5. Can Government Acquire Land in Lamu for Infrastructure?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Yes. Kenyan law provides for <strong>compulsory acquisition<\/strong>, but compulsory acquisition is subject to constitutional and statutory requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Land Act establishes the framework for compulsory acquisition of interests in land.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The National Land Commission plays a central role in the compulsory-acquisition process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The process involves steps concerning the proposed acquisition, notices, identification of affected interests, inquiry, valuation and compensation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Land Regulations provide, among other things, for publication of a notice of intention to acquire and service of notices on affected persons. They also require the Commission to collect information concerning matters such as the location, area, existing use, improvements and impacts of the proposed acquisition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that a landowner or affected person should not treat a compulsory-acquisition notice as a routine administrative letter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may have significant consequences for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ownership;<\/li>\n\n\n\n<li>possession;<\/li>\n\n\n\n<li>valuation;<\/li>\n\n\n\n<li>compensation;<\/li>\n\n\n\n<li>businesses;<\/li>\n\n\n\n<li>homes;<\/li>\n\n\n\n<li>crops;<\/li>\n\n\n\n<li>developments;<\/li>\n\n\n\n<li>access;<\/li>\n\n\n\n<li>mortgages;<\/li>\n\n\n\n<li>leases; and<\/li>\n\n\n\n<li>future use of the remaining land.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">6. What Rights Does a Landowner Have During Compulsory Acquisition?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The precise rights depend on the circumstances and the stage of the acquisition process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, important questions include:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Has the acquiring authority followed the statutory procedure?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The acquisition process must comply with the Constitution and Land Act.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Has the affected interest been properly identified?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A dispute may arise where the person registered on the title differs from an occupier or another person claiming an interest.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Has the land been properly valued?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The value of the land and relevant compensable interests may become disputed.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Have improvements been considered?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Buildings, crops and other improvements may become relevant depending on the circumstances.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Has compensation been determined and paid?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Compensation disputes can arise even after the principle of acquisition is no longer the central issue.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Has possession been taken lawfully?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The timing of possession can be legally significant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person facing compulsory acquisition should therefore obtain legal advice before signing documents or surrendering possession where the legal position is unclear.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">7. What Does Lamu Port and LAPSSET Have to Do With Land Law?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Lamu Port-South Sudan-Ethiopia Transport (LAPSSET) Corridor<\/strong> is one of the most important infrastructure developments affecting the county.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lamu Port is part of this wider infrastructure framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its development has already generated land-related litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, Kenyan courts have considered disputes involving land in Mokowe and the Lamu Port project, including claims concerning compulsory acquisition and compensation. One Environment and Land Court decision recorded that properties within the LAPSSET corridor had been identified for compulsory acquisition and that compensation had been paid to affected persons in the acquisition process, while separate disputes arose concerning particular parcels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This history matters because future investors should not consider land around major infrastructure corridors solely by looking at its current market price.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They should also ask:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>What infrastructure, planning or public-purpose development may affect this property?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">8. Buying Land Near Lamu Port: What Should You Check?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A buyer considering land near Lamu Port or another major infrastructure project should undertake more than a basic title search.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Due diligence may include:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ownership<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Confirm the registered proprietor and registration details.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Encumbrances<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Check for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>charges;<\/li>\n\n\n\n<li>cautions;<\/li>\n\n\n\n<li>restrictions;<\/li>\n\n\n\n<li>leases;<\/li>\n\n\n\n<li>easements;<\/li>\n\n\n\n<li>court orders; and<\/li>\n\n\n\n<li>other registered interests.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Land history<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Establish how the seller acquired the property.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Survey<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Confirm the boundaries and physical location.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Adjoining claims<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Determine whether neighbouring occupiers or communities claim an interest.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Planning<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Establish the permitted land use and applicable planning controls.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Infrastructure<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Determine whether roads, port infrastructure, utilities, corridors or other public projects affect the property.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Environmental considerations<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Some developments may require environmental assessment or other regulatory approvals.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Litigation<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Conduct appropriate searches for disputes affecting the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is where conveyancing and wider real-estate legal due diligence become particularly important.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">9. Can You Develop Land in Lamu Without Planning Approval?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Not necessarily.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Physical and Land Use Planning Act<\/strong> establishes a framework for planning, development control and land-use regulation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Act gives county governments functions relating to development applications and development permissions within their jurisdictions. Its development-control framework is intended to promote orderly development, environmental protection, public safety and public participation in development decision-making.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Act also expressly recognises the need for physical and land-use planning to consider economic, social and environmental needs, as well as the culture and heritage of affected communities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, acquiring land does not automatically mean that every proposed development can be constructed on it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A developer may need to investigate:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>zoning;<\/li>\n\n\n\n<li>permitted land use;<\/li>\n\n\n\n<li>development permission;<\/li>\n\n\n\n<li>subdivision requirements;<\/li>\n\n\n\n<li>building approvals;<\/li>\n\n\n\n<li>environmental requirements;<\/li>\n\n\n\n<li>infrastructure requirements;<\/li>\n\n\n\n<li>access;<\/li>\n\n\n\n<li>heritage considerations; and<\/li>\n\n\n\n<li>other sector-specific approvals.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">10. Public Participation and Lamu Development Projects<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Public participation can become particularly important where a development affects communities or involves public planning and environmental decision-making.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Physical and Land Use Planning Act expressly includes public participation among the objectives of development control.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, public participation should not be reduced to a slogan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal question in a particular project may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What decision is being made?<\/li>\n\n\n\n<li>Which law requires participation?<\/li>\n\n\n\n<li>Who is entitled to participate?<\/li>\n\n\n\n<li>What information must be available?<\/li>\n\n\n\n<li>Was reasonable notice given?<\/li>\n\n\n\n<li>Were affected communities able to provide meaningful input?<\/li>\n\n\n\n<li>Was the input considered?<\/li>\n\n\n\n<li>What decision was ultimately made?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These questions can become important in litigation where affected persons challenge planning or development decisions.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">11.
