It helps establish the registered proprietor and reveals registered interests such as charges, cautions and restrictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, a land search is <strong>not the entire due-diligence process<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A buyer should also investigate how the seller acquired the property, whether the land is inherited, whether other people occupy or claim an interest in it, whether the physical boundaries match the records, whether Land Control Board consent is required, and whether there are disputes or other legal restrictions affecting the transaction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kenya&#8217;s Land Registration Act gives registered title important legal protection, but it also recognises circumstances in which title can be challenged and interests that may affect land even where they are not recorded in the register.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For an Embu buyer, the practical rule is simple:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Do the land search before paying\u2014and investigate beyond the search before completing the purchase.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">What Is a Land Search?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A land search is an official inquiry into the land register relating to a particular parcel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is to establish the information recorded against the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the applicable registry and service, a search can help confirm matters such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>registered proprietor;<\/li>\n\n\n\n<li>parcel details;<\/li>\n\n\n\n<li>tenure;<\/li>\n\n\n\n<li>registered charges;<\/li>\n\n\n\n<li>cautions;<\/li>\n\n\n\n<li>restrictions;<\/li>\n\n\n\n<li>leases;<\/li>\n\n\n\n<li>other registered interests; and<\/li>\n\n\n\n<li>information relevant to dealings with the property.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Kenya&#8217;s <strong>Ardhisasa<\/strong> platform provides access to government land-information services and lists property search among its available services, alongside transfers, cautions, charges, restrictions, leases and other land-registration services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a target=\"_blank\" rel=\"noopener\" href=\"https:\/\/ardhisasa.lands.go.ke\/?utm_source=chatgpt.com\">Ardhisasa \u2014 Government Land Information Platform<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important distinction:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A land search tells you what is recorded.<\/h3>\n\n\n\n<h3 class=\"wp-block-heading\">Due diligence investigates whether the transaction is actually safe.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Those are not always the same thing.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">Why Should You Conduct a Land Search Before Paying?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine that you have found a one-acre parcel in Embu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The seller gives you a copy of the title and says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe land is clean. You can pay today.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">You pay KSh 500,000 as a deposit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Later, you discover that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a bank has a registered charge;<\/li>\n\n\n\n<li>someone lodged a caution;<\/li>\n\n\n\n<li>the seller inherited the property but succession was not completed;<\/li>\n\n\n\n<li>family members dispute the sale;<\/li>\n\n\n\n<li>the person negotiating the sale is not the registered owner;<\/li>\n\n\n\n<li>the parcel is smaller on the ground;<\/li>\n\n\n\n<li>another person occupies part of the land; or<\/li>\n\n\n\n<li>the seller has already entered into an agreement with another buyer.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A land search could have exposed some of these issues before you committed your money.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why <strong>the search should come before the deposit<\/strong>, not after.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">1. Confirm the Registered Owner<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The first question is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Who is actually registered as the proprietor of the land?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Compare the official search with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the seller&#8217;s identification documents;<\/li>\n\n\n\n<li>the title information;<\/li>\n\n\n\n<li>the sale agreement;<\/li>\n\n\n\n<li>any power of attorney;<\/li>\n\n\n\n<li>company documents where applicable;<\/li>\n\n\n\n<li>succession documents where applicable.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The name on the search should be carefully reconciled with the person selling the property.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What if the seller&#8217;s name does not match?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Do not automatically assume it is fraud.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There may be a legitimate explanation, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a registered attorney acting for the proprietor;<\/li>\n\n\n\n<li>an executor or administrator;<\/li>\n\n\n\n<li>a company representative;<\/li>\n\n\n\n<li>a recent transaction awaiting registration;<\/li>\n\n\n\n<li>a name-change issue.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But the explanation must be <strong>legally verified before you pay<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">2. Check the Title Number and Parcel Details<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Do not focus only on the owner&#8217;s name.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Confirm that the property described by the seller corresponds to the property you are actually being shown.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Check:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>title\/parcel number;<\/li>\n\n\n\n<li>registered acreage;<\/li>\n\n\n\n<li>location;<\/li>\n\n\n\n<li>tenure;<\/li>\n\n\n\n<li>ownership details;<\/li>\n\n\n\n<li>relevant registry information.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Then compare those details with the physical property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is particularly important where an agent is selling land using a general location such as:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cNear Embu town.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">or:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cA few minutes from Runyenjes.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The exact parcel matters.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">3. Check for a Charge<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A <strong>charge<\/strong> may indicate that the property has been used as security for a debt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, a landowner may have charged the property to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a bank;<\/li>\n\n\n\n<li>SACCO;<\/li>\n\n\n\n<li>financial institution; or<\/li>\n\n\n\n<li>another lender.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If a charge appears on the register, the buyer should not simply assume:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe seller will clear it later.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The transaction needs to address how the charge will be discharged and how the buyer&#8217;s transfer will be protected.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ask:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who is the chargee?<\/li>\n\n\n\n<li>How much is outstanding?<\/li>\n\n\n\n<li>Will the seller obtain a discharge?<\/li>\n\n\n\n<li>What documents will be required?<\/li>\n\n\n\n<li>At what stage will the discharge be registered?<\/li>\n\n\n\n<li>How will the purchase price be applied?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A transaction involving charged land requires careful completion arrangements.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">4. Check for a Caution<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A caution can be a major warning sign.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under section 71 of the Land Registration Act, a person claiming a contractual or other right capable of registration may lodge a caution against land. A caution can prohibit or restrict registration of dealings with the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 72 further provides that a disposition inconsistent with a registered caution generally cannot be registered while the caution remains, unless the cautioner consents or a court orders otherwise.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Why might a caution exist?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Potential reasons include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a previous purchaser claiming an interest;<\/li>\n\n\n\n<li>a beneficiary;<\/li>\n\n\n\n<li>a family dispute;<\/li>\n\n\n\n<li>a contractual dispute;<\/li>\n\n\n\n<li>an unpaid creditor or claimant;<\/li>\n\n\n\n<li>another person asserting an interest in the land.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Do not simply ask the seller:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cCan you remove the caution?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Find out <strong>why it exists<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reason can be more important than the caution itself.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">5. Check for a Restriction<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A restriction is different from a caution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under section 76 of the Land Registration Act, the Registrar can register a restriction to prevent or limit dealings with land for purposes including preventing fraud or improper dealing, compulsory acquisition, or for another sufficient cause.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A restriction can therefore be a significant warning that the property requires further investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Check:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>who placed the restriction;<\/li>\n\n\n\n<li>why it was registered;<\/li>\n\n\n\n<li>what dealings it prevents;<\/li>\n\n\n\n<li>whether conditions must be satisfied;<\/li>\n\n\n\n<li>whether it can be removed;<\/li>\n\n\n\n<li>whether removal has already been initiated.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Do not treat a restricted title as an ordinary sale.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">6. Check for an Inhibition<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A court can issue an <strong>inhibition<\/strong> preventing registration of dealings with land.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 68 of the Land Registration Act gives the court power to inhibit dealings with land, a lease or a charge for a specified period, until a particular event, or generally until further order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An inhibition may therefore indicate that the property is connected to court proceedings or another legal dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If one appears in the search, obtain the relevant court information before proceeding.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">7. Check the Ownership History<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A buyer should not always stop at:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe current owner is registered.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">For higher-risk transactions, investigate <strong>how the current owner became registered<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ask whether the land was acquired through:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>purchase;<\/li>\n\n\n\n<li>inheritance;<\/li>\n\n\n\n<li>transmission;<\/li>\n\n\n\n<li>subdivision;<\/li>\n\n\n\n<li>gift;<\/li>\n\n\n\n<li>transfer;<\/li>\n\n\n\n<li>allocation;<\/li>\n\n\n\n<li>company transaction; or<\/li>\n\n\n\n<li>another process.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The origin of the title can matter if questions later arise about its validity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 26 of the Land Registration Act provides that a certificate of title is prima facie evidence of ownership, subject to registered interests and the statutory grounds for challenge, including fraud or misrepresentation involving the proprietor and illegal, unprocedural or corrupt acquisition.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">8. If the Land Was Inherited, Check Succession<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most important checks for buyers in Embu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the seller says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThis was my father&#8217;s land. He left it to me.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That statement does not, by itself, establish that the seller has completed the legal process necessary to sell the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A buyer should investigate:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>whether the registered owner is deceased;<\/li>\n\n\n\n<li>whether a succession cause was filed;<\/li>\n\n\n\n<li>whether a grant was issued;<\/li>\n\n\n\n<li>whether the grant was confirmed;<\/li>\n\n\n\n<li>who was allocated the property;<\/li>\n\n\n\n<li>whether transmission occurred;<\/li>\n\n\n\n<li>whether the seller is now registered as proprietor;<\/li>\n\n\n\n<li>whether other beneficiaries have interests.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The High Court has recently stressed that beneficiaries should ordinarily sell transmitted portions after transmission, and that a certificate of confirmation of grant is not itself a title document proving that the beneficiary is the registered owner capable of disposing of the land.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The practical rule<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>If the registered owner is deceased, do not treat the transaction as an ordinary private land sale.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Have the succession documents reviewed before paying.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">9. Look Beyond the Register: Who Is Occupying the Land?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This is where many buyers make a mistake.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They obtain a search.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The search shows the seller.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They pay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They later discover that somebody else is living on or using the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A land search does not replace a physical inspection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When you visit the property, ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who lives here?<\/li>\n\n\n\n<li>Who cultivates the land?<\/li>\n\n\n\n<li>Who built the structures?<\/li>\n\n\n\n<li>Who has fenced the property?<\/li>\n\n\n\n<li>Who claims ownership?<\/li>\n\n\n\n<li>Who has been paying land-related expenses?<\/li>\n\n\n\n<li>Has anyone bought part of the land?<\/li>\n\n\n\n<li>Are there family members occupying it?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The answers may reveal issues that require further legal investigation.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">10. Check for Family or Customary Claims<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A registered title does not necessarily mean that every possible interest in the land will appear as a simple entry in the register.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 28 of the Land Registration Act recognises overriding interests including <strong>trusts, including customary trusts<\/strong>, certain rights of way and water, compulsory-acquisition rights and other interests recognised by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This matters particularly where land has a long family history.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A seller may be the registered proprietor while another person claims:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a beneficial interest;<\/li>\n\n\n\n<li>customary trust;<\/li>\n\n\n\n<li>family entitlement;<\/li>\n\n\n\n<li>right of access;<\/li>\n\n\n\n<li>another legally recognised interest.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">This is why physical and family-history due diligence can matter as much as the search.<\/h3>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">11.
