The Constitution gives every child the right to a name and nationality from birth and to parental care and protection, including equal responsibility of the mother and father whether or not they are married. It also makes the child&#8217;s best interests paramount in every matter concerning the child. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/2010\/constitution\/eng%402010-09-03\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Against that background, a <strong>Children (Amendment) Bill, 2026<\/strong> has appeared in Parliament&#8217;s legislative-proposals tracker. The proposal is sponsored by Nominated MP Hon. Umulkher Harun Mohamed. The parliamentary tracker confirms its existence as a legislative proposal, but the material currently publicly available does <strong>not provide enough detail to responsibly describe every proposed clause or claim that it has become law<\/strong>. <a href=\"https:\/\/www.parliament.go.ke\/sites\/default\/files\/2026-04\/LP%20TRACKER%2022.04.2026.pdf?utm_source=chatgpt.com\">Parliament of Kenya<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A legislative proposal is not the same thing as an enacted Act of Parliament.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So what should Kenyan parents understand about <strong>child identity, parentage and family rights<\/strong> while these issues continue to develop?<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">What Is a Child&#8217;s Legal Identity?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A child&#8217;s legal identity is created and documented through several legal records and relationships.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The child&#8217;s name<\/li>\n\n\n\n<li>Date and place of birth<\/li>\n\n\n\n<li>Nationality<\/li>\n\n\n\n<li>Birth registration<\/li>\n\n\n\n<li>Parentage<\/li>\n\n\n\n<li>Family relationships<\/li>\n\n\n\n<li>Adoption records where applicable<\/li>\n\n\n\n<li>Other official records identifying the child<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution expressly provides that every child has a right to a name and nationality from birth. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/2010\/constitution\/eng%402010-09-03\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Children Act also places responsibilities on parents relating to the child&#8217;s name and birth registration. Among the duties of a person with parental responsibility is determining the child&#8217;s name and procuring registration of the child&#8217;s birth. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/2022\/29\/eng%402022-07-29\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that birth registration is not simply an administrative formality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is part of establishing the child&#8217;s legal identity.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">Why Does Child Identity Matter?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A child&#8217;s identity can affect many areas of life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, identity documents may be relevant when a child needs to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Access education<\/li>\n\n\n\n<li>Obtain government services<\/li>\n\n\n\n<li>Establish nationality<\/li>\n\n\n\n<li>Travel<\/li>\n\n\n\n<li>Obtain a passport<\/li>\n\n\n\n<li>Access healthcare<\/li>\n\n\n\n<li>Participate in an adoption process<\/li>\n\n\n\n<li>Establish parental relationships<\/li>\n\n\n\n<li>Resolve a succession or inheritance issue later in life<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The importance of accurate identity becomes particularly obvious when information is missing or disputed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consider a child whose birth certificate does not accurately reflect their circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Or a child whose parentage is disputed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Or a child who has been abandoned and whose biological parents cannot be traced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These are not merely paperwork problems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They can become legal and family-law problems.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">What Does Kenyan Law Already Say About Parents?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Kenya&#8217;s current legal framework already recognises <strong>equal parental responsibility<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 32 of the Children Act provides that parents have parental responsibility on an equal basis and that neither the father nor mother has a superior right or claim over the other in exercising parental responsibility, whether the child was born within or outside marriage. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/2022\/29\/eng%402022-07-29\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is consistent with Article 53 of the Constitution, which provides for equal responsibility of the mother and father to provide for the child. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/2010\/constitution\/eng%402010-09-03\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, a family dispute cannot simply be approached from the assumption that one parent automatically has superior legal rights because of their gender or marital status.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The circumstances of the child and the applicable law matter.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">What Happens When Parents Disagree About a Child&#8217;s Identity?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Disputes can arise over matters such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The child&#8217;s name<\/li>\n\n\n\n<li>Surname<\/li>\n\n\n\n<li>Father&#8217;s name on the birth certificate<\/li>\n\n\n\n<li>Whether a person is a child&#8217;s parent<\/li>\n\n\n\n<li>DNA testing<\/li>\n\n\n\n<li>Changing information on a birth certificate<\/li>\n\n\n\n<li>Nationality<\/li>\n\n\n\n<li>Adoption<\/li>\n\n\n\n<li>Custody<\/li>\n\n\n\n<li>Parental responsibility<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These matters can become especially complicated where the parents disagree.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A recent 2026 High Court decision illustrates the point.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <strong>In re WBN (Minor)<\/strong>, the High Court considered an application concerning the removal of a father&#8217;s name from a child&#8217;s birth certificate and a change to the child&#8217;s name. The case demonstrates that questions surrounding birth records and parentage can become matters for judicial determination. <a href=\"https:\/\/sheria.net\/case\/akn\/ke\/judgment\/kehc\/2026\/1718?utm_source=chatgpt.com\">SheriaNet<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lesson for parents is straightforward:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Do not assume that information on a child&#8217;s birth record can simply be changed informally whenever the parents disagree.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The appropriate procedure depends on the circumstances.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">Can a Father&#8217;s Name Be Added to a Birth Certificate?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Kenya&#8217;s Births and Deaths Registration Act contains specific rules concerning entry of the father in the birth register.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 12 provides that a person may not be entered as the father of a child except at the joint request of the father and mother or upon production of evidence required by the registrar concerning marriage under the applicable legal provisions. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/1928\/2\/eng%402022-07-26\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that establishing or changing parentage on official records is a legal process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the parents disagree, or where parentage is contested, legal advice may be necessary before attempting to alter the records.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">What If the Father Is Not Named?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">The absence of a father&#8217;s name from a birth certificate does not necessarily resolve every question concerning biological or legal parentage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There may be circumstances in which:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The father was unknown<\/li>\n\n\n\n<li>The parents were not together<\/li>\n\n\n\n<li>The parents disagreed about registration<\/li>\n\n\n\n<li>The father was unavailable<\/li>\n\n\n\n<li>Parentage was disputed<\/li>\n\n\n\n<li>The child&#8217;s circumstances later changed<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where a dispute arises, the relevant evidence and legal procedure need to be considered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The child&#8217;s <strong>best interests remain central<\/strong> to proceedings concerning children. The Children Act expressly provides that the best interests of the child are the primary consideration in actions concerning children. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/judgment\/kehc\/2023\/26169\/eng%402023-12-01?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">What If a Child Does Not Know Their Biological Parents?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This can arise in cases involving abandonment, adoption or situations where a child&#8217;s biological family cannot be identified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kenyan courts have dealt with cases involving children who were abandoned shortly after birth.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, in <strong>In re Baby A (Child)<\/strong>, the High Court dealt with a child whose parents and nationality were initially unknown. The court applied Article 14(4) of the Constitution, which provides that a child found in Kenya who is or appears to be under eight years old and whose nationality and parents are unknown is presumed to be a Kenyan citizen by birth. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/judgment\/kehc\/2023\/26169\/eng%402023-12-01?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A later 2025 adoption decision similarly considered an abandoned child&#8217;s nationality, adoption and legal identity. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/judgment\/kehc\/2025\/5686\/eng%402025-04-30?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These cases demonstrate why child identity can become particularly important in adoption and child-protection proceedings.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">What Role Does the Child&#8217;s Best Interest Play?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most important principles in Kenyan children&#8217;s law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 53(2) of the Constitution states that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;A child&#8217;s best interests are of paramount importance in every matter concerning the child.&#8221;<\/strong> <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/2010\/constitution\/eng%402010-09-03\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The Children Act implements this constitutional principle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that a dispute between adults should not automatically be treated as a contest in which one parent&#8217;s preferred outcome wins.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court&#8217;s focus is the welfare and best interests of the child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the circumstances, that can involve considerations such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Safety<\/li>\n\n\n\n<li>Care<\/li>\n\n\n\n<li>Family relationships<\/li>\n\n\n\n<li>Education<\/li>\n\n\n\n<li>Health<\/li>\n\n\n\n<li>Stability<\/li>\n\n\n\n<li>The child&#8217;s views, depending on age and maturity<\/li>\n\n\n\n<li>Existing parental relationships<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">What About Family Relationships?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">A child&#8217;s identity is closely connected to family relationships.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A child may have relationships with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mother<\/li>\n\n\n\n<li>Father<\/li>\n\n\n\n<li>Siblings<\/li>\n\n\n\n<li>Grandparents<\/li>\n\n\n\n<li>Step-parents<\/li>\n\n\n\n<li>Other relatives<\/li>\n\n\n\n<li>Adoptive parents<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The law does not treat every family dispute simply as a dispute between two adults.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Children Act provides a framework dealing with parental responsibility, custody, care and protection, guardianship, foster care and adoption. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/2022\/29\/eng%402022-12-31\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This becomes especially important where parents separate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A separation does not automatically end a parent&#8217;s responsibilities toward the child.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">Does Marriage Determine Parental Responsibility?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Not in the way many people assume.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Children Act expressly states that equal parental responsibility applies whether or not the child was born within or outside wedlock. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/2022\/29\/eng%402022-07-29\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution similarly provides for equal responsibility of the mother and father to provide for the child, whether they are married to each other or not. <a href=\"https:\/\/new.kenyalaw.org\/akn\/ke\/act\/2010\/constitution\/eng%402010-09-03\/source?utm_source=chatgpt.com\">Kenya Law<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, parents should avoid assuming that marriage\u2014or the absence of marriage\u2014automatically determines all questions concerning parental responsibility.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 class=\"wp-block-heading\">What Could the 2026 Proposal Mean?<\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">At present, caution is necessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parliament&#8217;s legislative-proposals tracker confirms that a <strong>Children (Amendment) Bill, 2026<\/strong> was submitted as a proposal by Hon. Umulkher Harun Mohamed. <a href=\"https:\/\/www.parliament.go.ke\/sites\/default\/files\/2026-04\/LP%20TRACKER%2022.04.2026.pdf?utm_source=chatgpt.com\">Parliament of Kenya<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the publicly available tracker does not itself provide sufficient clause-by-clause detail to state that the proposal will definitely change a particular rule on child identity or family relationships.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, parents should distinguish between three different things:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1. Existing law<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These are rules already contained in the Constitution, Children Act and other applicable legislation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. A legislative proposal<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is an attempt to change or develop the law.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.
